Giving a Voice to the Injured

Federal Tort Claims Act Lawyer in Alexandria, VA

Injury Claims Against the U.S. Government Across Virginia, Maryland, & D.C.

Injuries caused by federal employees or on federal property follow a different legal path than a standard Virginia personal injury claim. The Federal Tort Claims Act (FTCA) is the federal law that allows private individuals to seek compensation from the United States government for negligence by federal employees. At The Barrera Law Firm, PLLC, we’re licensed across Virginia, Maryland, and Washington, D.C., which means we can pursue an FTCA claim wherever the responsible federal facility or incident is located, without referring your case elsewhere.

If you or a family member were injured by a federal employee or on federal property, contact The Barrera Law Firm, PLLC at (571) 290-2390 for a complimentary consultation. FTCA claims carry strict filing deadlines, and acting promptly can help protect your right to seek compensation.

When the FTCA Applies: Common Claims in the Alexandria, Virginia Area

An FTCA claim requires that a federal employee caused your injury through negligence or a wrongful act while performing official duties. The law doesn’t extend to independent contractors working for the federal government, except in narrow circumstances involving direct federal supervision, and it doesn’t apply to state or local government employees at all.

Northern Virginia has a significant concentration of federal facilities, and FTCA claims in this area tend to fall into a few common categories:

  • VA hospital medical malpractice: Errors in diagnosis, surgical mistakes, or medication failures at a Department of Veterans Affairs facility
  • U.S. Postal Service vehicle accidents: Collisions caused by USPS drivers while making deliveries or operating postal vehicles
  • Injuries on federal property: Slip-and-falls, trip hazards, or unsafe conditions on property owned or controlled by a federal agency
  • Military installation incidents: Injuries connected to facilities such as Fort Belvoir, which houses a major joint-service military medical center in Northern Virginia

How FTCA Claims Differ from Standard Virginia Injury Claims

Congress enacted the FTCA in 1946 to waive the federal government’s sovereign immunity, the legal doctrine that historically shielded it from civil liability. Before the statute, a person injured by a federal employee had no practical remedy. The FTCA changed that, but the process remains meaningfully different from a typical personal injury case.

Under the FTCA, the lawsuit names the United States as the defendant rather than the individual federal employee. There’s no jury. FTCA cases are resolved through a bench trial, meaning a federal judge weighs the evidence and decides the outcome. Attorney Daniel Barrera’s record of more than 100 trials as lead counsel is directly relevant here: presenting a case persuasively to a judge requires the same disciplined preparation that courtroom experience builds.

The filing deadline is also different. Virginia’s standard personal injury statute of limitations under Va. Code Section 8.01-243(A) gives claimants two years from the date of injury. An FTCA claim is governed by a separate federal deadline under 28 U.S.C. Section 2401(b), which requires presenting a written administrative claim to the responsible agency within two years of the incident.

The FTCA Claims Process: From Administrative Claim to Federal Court

Before any lawsuit can be filed, the FTCA requires submitting a written administrative claim directly to the federal agency responsible for the alleged negligence. No court action is permitted until that step is completed.

Submitting the Administrative Claim

The claim must describe the incident in detail and state a specific dollar amount sought, known as a “sum certain.” Standard Form 95 is the commonly used submission format. A claim submitted without a sum certain isn’t considered valid under the statute.

Agency Response & Next Steps

Once submitted, the agency generally has six months to respond under 28 U.S.C. Sections 2401(b) and 2675(a). Three outcomes are possible:

  • The agency accepts the claim and offers a settlement
  • The agency denies the claim in writing, typically triggering a six-month window to file suit in federal court
  • The agency doesn’t respond within six months, which the claimant may treat as a denial and proceed to court

For incidents in the Alexandria area, federal lawsuits are handled by the Alexandria Division of the U.S. District Court for the Eastern District of Virginia, which sits at the Albert V. Bryan U.S. Courthouse. We know this court and its procedures well.

Why Choose The Barrera Law Firm, PLLC for Your Federal Tort Claim

FTCA claims move through a process that most personal injury attorneys rarely encounter. The administrative phase, the sum certain requirement, the bench trial, and the jurisdictional nuances across the DMV all require deliberate handling from the start.

Trial Experience That Translates to Federal Court

We bring more than 75 years of combined legal experience and a record of more than $75 million recovered for injured clients. Attorney Daniel Barrera, a lifetime member of the Million Dollar Advocates Forum®, has served as lead counsel in more than 100 trials. Because FTCA cases are resolved by a judge rather than a jury, that trial record can translate directly into the preparation and presentation your case requires.

Multi-Jurisdictional Reach & Bilingual Representation

Our licensure in Virginia, Maryland, and Washington, D.C. means we can pursue a claim wherever the responsible federal agency or facility is located across the region. Our attorneys and staff communicate directly in Spanish, so every client fully understands the process, the deadlines, and the decisions being made on their behalf. You work with our attorneys directly, not with intermediaries.

Start Your FTCA Consultation Before the Deadline Passes

Missing the FTCA’s two-year administrative filing deadline can permanently bar a claim, regardless of how serious the injury was. The sooner we review your situation, the more options may remain available. We offer complimentary consultations and are available 24/7.
